Notice of Intent
Prior to any pesticide application, a Notice of Intent to Apply Restricted Materials (NOI) must be submitted to the Agricultural Commissioner. The NOI must be submitted at least 24 hours prior to the application. The NOI shall be given verbally, directly to the Agricultural Commissioner's Office either in person, by telephone answering device available 24 hours a day at (530) 662-1487, or by fax at (530) 662-6094. The following information is required for a Notice of Intent:
After the 24-hour period, the pesticide application may commence within four (4) days. If the application is delayed beyond four (4) days due to adverse weather or unavailability of equipment, a new NOI must be submitted (recalled). The Agricultural Commissioner, in deciding whether to issue a permit or when evaluating a NOI, most consider adverse environmental impacts, feasible alternatives to pesticide use, including no pesticide application, or mitigation measures that would substantially lessen any significant adverse impact on the environment. The Permit application does not become valid until the NOI for the job has been received and approved by the Agricultural Commissioner. The NOI may be submitted by the permittee, Authorized Agent, or the Pest Control Business, but the Permitee shall be responsible for compliance with all Permit Conditions. A request for a waiver of the 24-hour NOI may only be made by the Permittee or Authorized Agent.
